Notice of Receipt of Ballot Title for November 8, 2022 General Election

NOTICE OF RECEIPT OF BALLOT TITLE
FOR THE NOVEMBER 8, 2022 GENERAL ELECTION

Notice is hereby given that the City Recorder received from the City Attorney on July 25, 2022 a ballot title for a measure to be referred to the legal voters of the City of Lebanon.

CAPTION:  Delays psilocybin-related businesses within Lebanon for two years.

QUESTION:  Shall Lebanon delay psilocybin-related businesses for two years?

SUMMARY:  State law allows for the manufacturing, transportation, delivery, sale and purchase of psilocybin, the psychedelic drug found in certain mushrooms.  State law provides that a local government may adopt an ordinance to be referred to the voters to delay the establishment of licensed psilocybin product manufacturers and/or psilocybin service centers.  The Lebanon City Council adopted an ordinance to refer to the voters that temporarily prohibits psilocybin-related businesses in Lebanon to enable the city to consider local regulations once the state’s psilocybin regulatory program is established.

Approval of the measure would delay the establishment of psilocybin product manufacturers and psilocybin service centers within the Lebanon city limits until December 31, 2024.

NOTICE IS FURTHER GIVEN that any elector of the city who believes the draft ballot title contains more than one subject or who believes the ballot title is insufficient, not concise, or unfair may file a petition for judicial review with the Circuit Court for Linn County no later than 5 PM on August 3, 2022 which is at least seven business days after this notice.

Any elector who files a petition to review the draft ballot title must notify the City Recorder in writing that the petition has been filed no later than 5:00 PM on the next business day following the day the petition is filed.
